By placing an order with 4th Quarter Creations, LLC, you agree to be bound by the following Terms and Conditions. These terms may be updated at any time. It is your responsibility to review them regularly.

ARTWORK, DESIGN & PRODUCTION TERMS
- All text content MUST be emailed to info@4thquartercreations. When your job is ready for production and we are prepared to go to print, all edits will be finalized, the copy carefully proofread, and all design issues should be settled. Under no circumstances will production start without customers’ approval and payment of the order. NO EXCEPTIONS! We will not take responsibility for any copy or design errors committed on your part after the order has been approved. We are also not responsible for any wrong dates or misspelled words in files submitted by the Customer or jobs approved by the Customer upon design completion. We DO NOT ACCEPT SCREENSHOTS OR PHOTOS OF iPhone NOTES. PRODUCTION WILL NOT START UNTIL THE ORDER IS APPROVED.

Under no circumstances will a refund or reprint be honored for approved orders. NO EXCEPTIONS!

Please note that 4th Quarter Creations, LLC cannot be responsible for the following:

•Spelling, punctuation, or grammatical errors made by the end user.
•Poor quality or low-resolution of submitted images.
•Design errors introduced by the Customer in the document creation process.
•Errors in user-selected options such as choice of finish, quantity, or product type.
•Damage to the products arising after delivery to the end user.
•The differentiation of colors and sizes as they appear on the end user’s computer screen during the ordering process before processing, as compared to the finished products.
 

TURNAROUND TIMES ARE NOT GUARANTEED
All of our turnaround times are estimates only and NOT guarantees. Please remember that several things that can go wrong with the printing process are out of our control. The turnaround times we give are based on actual statistics of jobs we have done in the past and are NOT guaranteed. Under no circumstances will a refund be honored for a delay in our estimated turnaround time. NO EXCEPTIONS!

COLORS ARE NOT GUARANTEED
Because of limitations with our printing process and neighboring image ink requirements, the accuracy of color reproduction is not guaranteed. By placing an order with us, you agree to this limitation. We accept no responsibility for color variations between the submitted files and the final printed piece. Under no circumstances will a refund or reprint be honored for color variations that have occurred during the printing process. NO EXCEPTIONS!

CUTTING & SIZE LIMITATIONS
We accept no responsibility for size variations below or above 1/16" to 1/8". We strongly recommend that you do not use borders on your print job. Since the cuts may be off slightly by as much as 1/8", folds, perforations, and score lines may also be off by as much as 1/8". Under no circumstances will a refund or reprint be honored for cutting or size variations that have occurred during the printing process within these specifications. NO EXCEPTIONS!

QUANTITY VARIATIONS
Most of the time, we will print slightly more than what you ordered for no additional charge. As printing industry trade standards allow for underages of up to 10%, sometimes we will print slightly fewer pieces than you ordered. If you are doing a mailing and need to receive the exact amount ordered, it is best to communicate this to someone in our production department at the time you place your order. Under no circumstances will a refund or reprint be honored for a quantity shorted less than 10%. NO EXCEPTIONS!

GARMENT PRINTING 

Customers can supply their own garments. Customer-supplied garments are accepted on the strict understanding that 4th Quarter Creations, LLC will not accept any liability whatsoever for any misprints, stains, or damage to the customer-supplied garments. Our printing process and other decorating techniques, such as DTF(Direct to Film), screen printing, and embroidery, involve high heat and other treatments that may impact the quality of the decoration and the item to be decorated. In addition, there is some risk that printer and human errors will occur. All garments are left entirely at the Customer’s own risk. If you supply the garment and there is an issue with the garment you provided, we do not replace your item nor reimburse you for the item’s value. Your damaged item will be returned to you. Our catalog is extensive, and we are confident that one of our suppliers could fulfill your garment needs, no matter what you are looking for. Under no circumstances will a refund or reprint be honored for customer-supplied garments that are damaged upon receipt or during production due to the quality of Customer customer-supplied garments. NO EXCEPTIONS!
 

NATIONWIDE SHIPPING
We will not be responsible for shipping delays or lost shipments caused by third-party shipping companies. Under no circumstances will a refund or reprint be honored for a shipping delay or lost shipment. NO EXCEPTIONS!

PAYMENT IN ADVANCE
All orders MUST be paid in advance with either cash, Visa, MasterCard, Discover, or American Express. PERSONAL OR BUSINESS CHECKS WILL NOT BE ACCEPTED. There are absolutely no exceptions. All custom quotes received from 4th Quarter Creations, LLC, are valid for 30 days only from the date of the quote. Orders MUST be paid in full and approved before the order will be moved to production. NO EXCEPTIONS! If you approve your order on the weekend, holiday, or outside of regular business hours, your order will go into production on the next business day after approval and payment. Under no circumstances will 4th Quarter Creations, LLC be held responsible for the delayed production of a job due to non-payment. NO EXCEPTIONS! 

 

CANCELLATION & REFUND POLICY
There is absolutely no way to cancel the order once payment is received and is moved into production. NO EXCEPTIONS! Customer agrees that by placing an order with us, the Customer has incurred and is paying for services provided and that regardless of whether the Customer refuses to take delivery of such product ordered, 4th Quarter Creations, LLC has rendered a service for which it shall be paid in full. The Customer agrees that by placing any such order, the Customer will not cancel or terminate the order or refuse any such payment for the services provided. In addition, the Customer authorizes 4th Quarter Creations, LLC. to use these terms and conditions with any credit card company or financial institution to establish that Customer is not allowed to cancel any such order and that any such charge-back is improper.

Services and Conditions of Use
As part of our service, we agree to provide you with information and other services that we may decide to offer, subject to the terms and conditions set forth herein. Upon notice published through this website, we may modify these terms and conditions at any time. You agree and continue to agree to use our services in a manner consistent with all applicable laws and regulations and in accordance with the terms and conditions set out in the policies and guidelines outlined below. Please note that this agreement will refer to you as a 'customer.'

Indemnification
The Customer will indemnify and hold harmless 4th Quarter Creations, LLC and its affiliates from any and all loss, cost expense, and damages on any and all manner of claims, demands, actions, and proceedings that may be instituted against 4th Quarter Creations, LLC. on the grounds or basis alleging that said printing violates any copyright or any proprietary right of any person. You certify that you own the rights to use the image(s) being reproduced on your order.

Rules For Online Conduct
By using the service, you agree that you will not attempt to undermine the integrity of the 4th Quarter Creations, LLC website.

Trademarks
All trademarks appearing on the 4th Quarter Creations, LLC website are trademarks of their respective owners.

Right to Subcontract
4th Quarter Creations, LLC shall have the right to assign any portion of the work required to another contractor.

Sample Product Use
4th Quarter Creations, LLC may use your product for samples or advertising purposes.

Limitation Of Liability And Warranty
The Customer and user of this website (“Customer”) agree that the use of the service is entirely at the Customer’s own risk. Services and products are provided ‘As Is,’ without warranty of any kind, either express or implied, including without limitation any warranty for information, services, uninterrupted access, or products provided through or in connection with the service, including without limitation the software licensed to the Customer and the results obtained through the service. Expressly, we disclaim all warranties, including without limitation: 1) Any warranties concerning the availability, accuracy, or content of information, products, or services; and 2) Any warranties of title or warranties of merchantability or fitness for a particular purpose. 

 

This Disclaimer of Liability applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction, or unauthorized access to, alteration of, or use of record, whether for breach of contract, tortious behavior, negligence, or under any other cause of action. The Customer acknowledges explicitly that the service is not liable for the defamatory, offensive, or illegal conduct of other customers or third parties and that the risk of injury from the foregoing rests entirely with the Customer.

Neither 4th Quarter Creations, LLC nor any of its agents, affiliates, or content providers shall be liable for any direct, indirect, incidental, special, or consequential damages arising out of the use of the service or inability to gain access to or use the service or out of any breach of any warranty. The Customer hereby acknowledges that the provisions of this section shall apply to all content on the service.

Changes
4th Quarter Creations, LLC. may change, modify, add, or remove portions of this policy at any time, and any changes will become effective immediately upon being posted unless we tell you otherwise.
